Public Notice of Hearing Borough of Harvey Cedars Please take notice that Nina and Mike Melker have appealed to the Land Use Board of the Borough of Harvey Cedars in the County of Ocean for Variances from Borough Ordinances relative to proposed house raising and new decks on the property designated as Lot 19 Block 53 on the Tax Map of the Borough of Harvey Cedars, located at 7403 Long Beach Boulevard. The applicant is seeking to elevate the structure and create a 2-car garage enclosure on the ground floor and also construct two new exterior decks with associated staircases and possibly an exterior lift. The following variances are requested from the Harvey Cedars Zoning Ordinance. Harvey Cedars Zoning Ordinance: Zoning: The subject site lies within the RA-Single Family Residential Zone. The following setbacks are required: a. Front Yard Setback- Existing front yard set back is 14.5FT where 20FT is required. This is a nonconforming condition and no change is proposed. b. Side Yard Setbacks- Proposed side yard setbacks to the new decks are 8.6FT +/- and 9.2FT +/- where 10FT on each side is required. A variance is required. c. Lot Area- Existing Lot Area is 3,000SF where 5,000SF is required. This is an existing nonconforming condition and no change is proposed. d. Building Coverage- Proposed building coverage including the open decks is 41% where 33%is the maximum permitted. A variance is required. If the Land Use Board determines that any other variances, exceptions or waivers are necessary or appropriate at the hearing, then such variances, waivers or exceptions will be requested. e. The Applicant is seeking a Use Variance whereas the present use as a duplex is a pre-existing non-conforming Use which is being expanded. A public hearing has been rescheduled for October 16, 2025 at 7:00 p.m. in the Municipal Building, 7606 Long Beach Boulevard, Harvey Cedars, New Jersey, at which time you may appear personally or by agent or Attorney and present any objections which you may have, to the granting of the application.
