RESOLUTION NO. 2623 A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF TOLLESON, ARIZONA, AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY IN THE CITY FOR PUBLIC PURPOSES, AUTHORIZING AND DIRECTING THE MAYOR, CITY MANAGER AND CITY ATTORNEY TO ACQUIRE TITLE TO MARICOPA COUNTY ASSESSOR'S PARCEL NO. 102-49-032 LOCATED AT THE NORTHEAST CORNER OF 93RD AVENUE AND VAN BUREN STREET, TOLLESON, ARIZONA, ON BEHALF OF THE CITY BY PURCHASE FOR AN AMOUNT NOT TO EXCEED $370,000, PLUS ACQUISITION AND CLOSING COSTS. WHEREAS, the continued growth and development of the City of Tolleson requires the acquisition of certain real property, described in Exhibit A, attached hereto and made a part hereof; and WHEREAS, the Council of the City of Tolleson finds that acquisition of the property described is necessary for public purposes, and it is in the public interest to acquire such property, and WHEREAS, the Council of the City of Tolleson has considered alternatives available to it, has balanced the public good and the private injury resulting from the acquisition of the property, and has determined that locating the public improvements on the property results in the greatest public good and the least private injury. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF TOLLESON, ARIZONA: Section 1. That the Mayor, City Manager and City Attorney are hereby authorized and directed to acquire title to and possession of the real property described in Exhibit A by donation, eminent domain or purchase for an amount not to exceed fair market value up to and including $370,000, plus acquisition and closing costs; and Section 2. The Mayor, City Manager, City Engineer, City Clerk and City Attorney are hereby authorized to perform all acts necessary to acquire said property and directed to execute all documents and take all steps necessary to carry out the purpose and intent of this Resolution on behalf of the City. PASSED AND ADOPTED by the Mayor and Council of the City of Tolleson, Arizona, on this 14th day of October, 2025.
