NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that at 6:00 P.M. on the 6th day of August 2026, a hearing will be heard before the Southampton Township Land Development Board at the Municipal Building located at 5 Retreat Rd., Southampton, NJ 08088 on the application of Philip Robison and Jeanie Robison ("Applicant") for: (1) a determination that the Applicant's proposed addition is a "de minimis" intensification of the present non-conforming use that does not require a formal (d)(2) use variance under N.J.S.A. 40:55D-70; or (2) alternatively, a (d)(2) use variance under N.J.S.A. 40:55D-70 on the ground that "special reasons" exist for the variance and that it will not do substantial detriment to the public good or substantially impair the intent and the purpose of the zone plan.
The property in question is located at Block 507, Lot 11 on the Official Tax Map of the Township of Southampton. The street address is: 707 Washington St., Southampton, NJ 08088.
Applicant is the owner of 707 Washington St., Southampton, New Jersey (Block 507, Lot 11). It is presently a two-bedroom, one-bathroom, single-family, residential property located in the Crescent Heights neighborhood of Southampton Township. Applicant seeks to bump out the rear of the current structure by 10 feet to construct a new bedroom, bathroom, and laundry. The total square footage of the proposed new addition is less than 300 square feet.
While the majority of the homes in the Crescent Heights neighborhood are in the Rural Residential or RR district, Applicant's property lies toward the edge of the neighborhood and just over the line in the Highway Commercial or HC district. "Single family detached dwellings" are a permitted use in the RR district, but they are not a permitted use in the HC district. As such, Applicant's present use of the property as a single-family, residential property is a non-conforming use. The Applicant's proposed addition to the structure could be viewed as an intensification of that non-conforming use, thereby requiring the need for a (d)(2) use variance under N.J.S.A. 40:55D-70.
The Applicant seeks the following relief as part of its application:
(1) A determination that the proposed addition is a "de minimis" intensification of the non-conforming use that does not require a formal (d)(2) use variance under N.J.S.A. 40:55D-70.
(2) Alternatively, a (d)(2) use variance under N.J.S.A. 40:55D-70 on the ground that "special reasons" exist for the variance and that it will not do substantial detriment to the public good or substantially impair the intent and the purpose of the zone plan.
IN ADDITION TO THE ABOVE, Applicant will seek any other variances, waivers, or exceptions which the Land Development Board may deem necessary.
THE APPLICATION AND SUPPORTING DOCUMENTS are on file in the office of the Township of Southampton Land Development Office, 5 Retreat Rd., Southampton, NJ 08088 and are available for inspection during normal working hours, 10 days prior to the meeting by appointment only.
THIS NOTICE IS SUBMITTED in accordance with the requirements of the Municipal Land Use Law. Any interested party may appear at the hearing and participate therein accordance with the rules of the Municipal Land Use Law.
