NOTICE OF ORDER APPOINTING GUARDIAN AD LITEM NISI AND ATTORNEY
TO: THE DEFENDANTS HEREIN, NAMES AND ADDRESSES UNKNOWN, INCLUDING ANY THEREOF WHO MAY BE MINORS, IMPRISONED PERSONS, INCOMPETENT PERSONS, UNDER OTHER LEGAL DISABILITY OR IN THE MILITARY SERVICE, IF ANY, WHETHER RESIDENTS OR NON-RESIDENTS OF SOUTH CAROLINA AND TO THE NATURAL, GENERAL, TESTAMENTARY GUARDIAN OR COMMITTEE, OR OTHERWISE, AND TO THE PERSON WITH WHOM THEY MAY RESIDE, IF ANY THERE BE:
PLEASE TAKE NOTICE that a Motion for an order appointing Kelley Woody, Esquire, as Guardian ad Litem Nisi, for all persons whomsoever herein collectively designated as Richard Roe or John Doe, defendants herein, names and addresses unknown, including any thereof who may be minors, imprisoned persons, incompetent persons, or under other legal disability, and as Attorney for said parties who may be in the military service, whether residents or non-residents of South Carolina, was filed in the Office of the Clerk of Court for Spartanburg County.
YOU WILL FURTHER TAKE NOTICE that unless the said minors or persons under other legal disability, if any, or someone in their behalf or in behalf of any of them, shall within thirty (30) days after service of notice of this order upon them by publication, exclusive of the day of such service, procure to be appointed for them, or either of them, a Guardian ad Litem to represent them for the purposes of this action, the appointment of said Guardian ad Litem Nisi and Attorney shall be made absolute.
SUMMONS AND NOTICE OF FILING COMPLAINT
TO THE DEFENDANTS ABOVE NAMED:
YOU ARE HEREBY SUMMONED and required to answer the Second Amended Complaint in this action, a copy of which is herewith served upon you, and to serve a copy of your answer to the said Second Amended Complaint upon the subscribers, at their office, 3200 Devine Street, Columbia, South Carolina or at Post Office Box 11682, Columbia, South Carolina 29211, within thirty (30) days after the service hereof, exclusive of the day of such service; and if you fail to answer the Second Amended Complaint in the time aforesaid, judgment by default will be rendered against you for the relief demanded in the Second Amended Complaint.
NOTICE IS HEREBY GIVEN that the original Complaint in the above entitled action was filed in the office of the Clerk of Court for Spartanburg County on September 8, 2025.
SECOND AMENDED LIS PENDENS
TO THE DEFENDANTS ABOVE NAMED:
NOTICE IS HEREBY GIVEN that an action will be commenced in this Court upon the Complaint of the above-named Plaintiff against the above-named Defendants for the foreclosure of that certain Mortgage of Real Estate given by Jessica Nichole Dockery, now deceased, to Mortgage Electronic Registration Systems, Inc. as nominee for Midland Mortgage Corporation, its successors and assigns, dated October 19, 2020, and recorded on December 16, 2020, in the office of the Register of Deeds for Spartanburg County, South Carolina in Book 5970 at Page 181 (the "Mortgage"). A Subordination of Mortgage was recorded August 26, 2025 in Book 7042 at Page 580.
By Mortgage Assignment (the "Assignment"), Mortgage Electronic Registration Systems, Inc. as nominee for Midland Mortgage Corporation assigned the Mortgage to the Plaintiff, and the Assignment was recorded February 18, 2021, in Book 6020 at Page 594 in the office of the Register of Deeds for Spartanburg County, South Carolina.
At the time of the filing of this notice, the premises affected by the said action were situated in the County of Spartanburg, State of South Carolina, and are described as follows:
All that certain piece, parcel or lot of land, with all improvements constructed thereon, lying and being situate in the State of South Carolina, County of Spartanburg, North of Cowpens, fronting on Battleground Road and being more particularly described as follows:
Beginning at an iron on Battleground Road at corner of n/f H.L. Jarrett Estate property and running thence S. 86-00 W. 300 feet to an iron pin; thence N. 10-30 E. 116 feet to an iron pin; thence N. 76-30 E. 236 feet to an iron pin on the Battleground Road; thence along said road S. 16-30 E. 163 feet to the point of beginning.
LESS and EXCEPTED therefrom that certain 0.042 acre (1.835 square feet, more or less) conveyed to the South Carolina Department of Transportation by deed of Debra G. Turner as recorded in the RMC Office for Spartanburg County, South Carolina in Deed Book 118-Q at Page 626.
This being the same property conveyed to Jessica Nichole Dockery by deed of Cory Wickline dated October 19, 2020 and recorded December 16, 2020 in the Office of the Register of Deeds for Spartanburg County, South Carolina in Book 130-H at Page 932.
