STATE OF FLORIDA DEPARTMENT OF ENVIRONMENTAL PROTECTION NOTICE OF PROPOSED AGENCY ACTION The Florida Department of Environmental Protection (FDEP) gives notice that it proposes to approve a No Further Action Proposal with institutional controls and issue a Site Rehabilitation Completion Order with Controls for a contaminated site. Pulte Home Company, LLC. (Pulte) is seeking this Order in reference to FDEP Facility Number: ERIC_11332 for Bonita Springs Country Club at 10200 Maddox Lane, Bonita Springs, FL 34135 and intends to restrict exposure to contamination in the following manner: through completed soil management activities and restrictions on withdrawals from the Water Table aquifer. The Soil Management Completion Report submitted by Pulte to the Department of Environmental Protection confirms that all managed soil at the site meets the applicable Soil Cleanup Target Level for residential land use per Chapter 62-777 Florida Administrative Code. The previously recorded Declaration of Restrictive Covenant (reference Instrument No. 2019000172797 as recorded in the Official Records of Lee County Florida) restricts withdrawals from the Water Table aquifer and the drilling of wells at the site. Complete copies of the No Further Action proposals, the recorded restrictive covenant, and the Department's preliminary evaluation are available for public inspection during normal business hours 8:00 a.m. to 5:00 p.m. Monday through Friday, except legal holidays at 2295 Victoria Avenue Unit 364, Fort Myers, FL 33901 or online at https://depedms.dep.state.fl.us/Oculus/ (use FDEP Facility No. ERIC_11332). Local governments with jurisdiction over the property subject to the institutional control, real property owner(s) of any property subject to the institutional control, and residents of any property subject to the institutional control have 30 days from publication of this notice to provide comments to the Department.
