SUBSTITUTE TRUSTEE'S SALE
Default having been made in the terms, conditions, provisions and payments made and provided for in a Deed of Trust dated September 14, 2018, executed by William Spann and Dennie Spann, to Donald Richardson, Trustee, and recorded in Volume V1352, Page 229 in the Register's Office for Dickson County, Tennessee, to secure the indebtedness therein described to Bank of Dickson, and the entire indebtedness having been called due and payable as provided in said deed of trust, and said payment not having been made, and the lawful owner and holder of said indebtedness having appointed the undersigned, David G. Mangum, as substitute trustee by written instrument dated April 22, 2025, recorded in Volume V1589, Page 2815 in the above mentioned Register's Office, notice is hereby given that I, the undersigned substitute trustee, or my designated agent, under the power and authority vested in me by said deed of trust, and having been requested to do so by the lawful owner and holder of said debt, will on Friday, November 14, 2025 at 4:00 pm at the main entrance of the Dickson County Justice Center, 500 Spring Street, Charlotte, TN 37036, sell at public outcry to the highest and best bidder for cash, free from the equity of redemption, homestead and dower, and all other exemptions and rights of every kind, all of which are expressly waived in said deed of trust, the following described tract or parcel of land more particularly described as follows, to-wit:
PARCEL ONE: Lying and being in the Twelfth Civil District of Dickson County, State of Tennessee, and being more particularly described as follows:
BEGINNING at a pile of stones, old poplar corner, southeast comer of W, W. Jordan tract, corner of Preacher J. O. Reavis and W. C. Todd; runs with Todd's north boundary line; thence North 75 degrees East 43 poles to center of Lahay Branch, with ash and sycamore pointers; thence South 10 degrees East 25 poles; thence South 60 degrees East 30 poles with meanders of said branch to corner, with beech pointers; thence South 75 degrees East 13 poles to Allburt's corner; thence South 70 degrees East 40 poles; thence North 79 East 36-1/2 poles; thence South 64 degrees East 14 poles; thence North 65 degrees East 17 poles; thence North 35 degrees East 15-1/2 poles; thence North 52 degrees East 10 poles; thence North 50 degrees East nine (9) poles; thence North 59 degrees East 18 poles to Indian Camp Creek; thence up said creek, North 29 degrees West 11 poles; thence North 8 degrees West 10 poles; thence North 21-1/2 degrees East 22-1/2 poles; thence North 19 degrees West 10-1/4 poles; thence North 50 degrees West 10 poles to a permission; thence North 30 degrees West 15-1/2 poles; thence North 49 degrees West 13-1/2 poles; thence North 36 degrees West 12 poles; thence North 24-1/2 degrees West 12 poles to a sugar tree; thence North 23 degrees West 13 poles; thence North one degree West 9-1/3 poles to A. J. Caldwell's corner (now R. M, Williams corner) to an iron stake; thence with said Caldwell's (now R. M. Williams) South boundary line West 263 feet poles to Mrs. W. W. Jordan's northeast corner; thence South 3-1/2 degrees West 109 poles to the beginning, containing 283 acres, be the same, more or less.
PARCEL TWO: Lying and being in the Twelfth Civil District of Dickson County, State of Tennessee, and being more particularly described as follows:
TRACT NO. 1: BEGINNING at an iron pin in the East right-of-way margin of a 50 foot roadway which provides access to this property from Turnbull Road, said point being the southwest corner of a 42.5 acre tract (Tract No. 10); running thence with the South boundary line of said 42.5 acre tract North 80 degrees 9 minutes East 3032.68 feet to an iron pin in the West right-of-way margin of Indian Camp Road; thence with the right-of-way margin of said road and with a fence line to points as follows: South 41 degrees 5 minutes East 184.63 feet to an iron pin; South 63 degrees 37 minutes East 168.60 feet to an iron pin; South 77 degrees 46 minutes East 183.70 feet to an iron pin; South 38 degrees 42 minutes East 379.81 feet to an iron pin and South 39 degrees 25 minutes East 172.62 feet to an iron pin, the northeast corner of a 45.1 acre tract (Tract No. 12); thence with the North boundary line of said 45.1 acre tract, North 89 degrees 54 minutes West 3754.60 feet to an iron pin in the East right-of-way margin of the 50 foot roadway; thence along a curve to the left
having a radius of 542.39 feet, a distance of 35.0 feet to a point; thence North 10 degrees 11 minutes West 126.05 feet to the point of beginning, containing 38.5 acres, more or less, by survey of E. Ralph Robertson, Jr. RLS No. 425, and being Tract No. 11 as shown on said survey plat.
TRACT NO, 2: BEGINNING at an iron pin in the East right-of-way margin of a 50 foot roadway which provides access to this property from Turnbull Road and being the southwest corner of the 38.5 acre tract (Tract No. 11); running thence with the South boundary line of said 38.5 acre tract, South 89 degrees 54 minutes East 3754.60 feet to an iron pin in a fence line at the West right-of-way margin of Indian Camp Road; thence with said fence line to points as follows: South 41 degrees 47 minutes East 287.10 feet to an iron pin; South 50 degrees 49 minutes East 175.80 feet to an iron pin and South 60 degrees 14 minutes East 187.73 feet to an iron pin; thence continuing with the fence line but leaving the road South 11 degrees 3 1 minutes East 202.64 feet to an iron pin in a fence corner, the southeast corner of this tract; thence with the fence line, North 87 degrees 35 minutes West 4315.05 feet to a point in the East right-of-way margin of the afore-mentioned 50 foot roadway; thence with the East right-of-way margin of said roadway, North 4 degrees 53 minutes East 320.26 feet to a point and along a curve to the left with a radius of 542.39 feet to a distance of 120.81 feet to the point of beginning, containing 45.1 acres, more or less, by survey by E. Ralph Robertson, Jr., RLS 425, and being Tract No. 12 as shown on the plat.
INCLUDED IN THE ABOVE DESCRIPTION, BUT EXCLUDED ARE THE FOLLOWING EXCLUSIONS:
EXCLUSION ONE: 3 acre tract located approximately 730 feet South of East Side Road and East of and adjacent to Gill Road, and being more particularly described as follows:
BEGINNING at an axle found in the East right-of-way of Gill Road, said axle being located 730 feet from the intersection of Gill Road and East Side Road as measured along Gill Road, said axle also being the southwest corner of the Lester Fetzer property as recorded in Volume 206, Page 276, in the Register's Office of Dickson County, Tennessee; thence leaving said East right-of-way and with the South line of Fetzer, North 80 degrees 37 minutes 59 seconds East for a distance of 521.33 feet to an iron pin set; thence leaving Fetzer and on four new division lines as follows: South 10 degrees 19 minutes 51 degrees East for a distance of 267.54 feet to an iron pin set; thence South 80 degrees 37 minutes 59 seconds West for a distance of 428.98 feet to an iron pin set; thence North 37 degrees 30 minutes 02 seconds West for a
distance of 160.68 feet to an iron pin set; thence North 24 degrees 42 minutes 28 seconds West for a distance of 78.61 feet to an iron pin set in the East side of a 50 foot right-of- way for Gill Road; thence with the East side of said right-of-way North 09 degrees 42 minutes 01 second West for a distance of 50.00 feet to the point of beginning, containing 3.00 acres, more or less, based on a physical survey by Billy Ray Suiter, Surveyor RLS No. 1837, dated May 3, 2004.
EXCLUSION TWO: All lots of White Bluff Hills Subdivision, Section C, as shown on plat of record in Cabinet G, Slide 273, in the Register's Office of Dickson County, Tennessee, to which reference is hereby made for a more complete description.
EXCLUSION THREE: All that portion of White Bluff Hills, Section D, as shown on plat of record in Cabinet H, Slides 122-123, in the Register's Office of Dickson County, Tennessee, to which reference is hereby made for a more complete description, lying within the bounds of the above described property.
Being part of the same property conveyed to William Spann and Dennie Spann by Warranty Deed dated August 20, 1996 and recorded September 6, 1996 from Donna Rae Caldwell Tetreqult, Greta Jane Caldwell Hall, Betty Jean Caldwell Hall, Warner Jackson Caldwell, Carl Davis Caldwell and Kenneth Joe Caldwell, of record in Volume 439, Page 115, in the Register's Office of Dickson County, Tennessee.
And being part of the same property conveyed to William Spann and Dennie Spann by Warranty Deed dated June 2, 2004 and recorded June 3, 2004 from Gerald E. Deal and wife, Judy D. Deal, of record in Volume 791, Page 214, in the Register's Office of Dickson County, Tennessee.
And also being part of the same property conveyed to William Spann, by Quitclaim Deed dated February 18, 2022 and recorded September 15, 2023 from Bunnie Cherry and Angela Lunn, of record in Volume V1562, page 1733, Register's Office for Dickson County, Tennessee.
Subject to any and all existing ROW, easements, setback lines and restrictive covenants of record in said Register's Office.

This sale is subject to any and all unpaid real estate taxes; restrictive covenants, easements and setback lines; any and all redemption rights, including rights of redemption of any governmental agency, State or Federal, and any and all prior liens or encumbrances against said real property. Said sale is further subject to matters that an accurate survey of the property might disclose.
The property sold pursuant to this notice shall be sold "AS IS" and neither the Substitute Trustee nor the beneficiary of the Deed of Trust, nor any agent or attorney therefore, makes or shall make any warranty, whether express or implied, as to the condition, quality or quantity thereof, including, but not limited to, the enforceability of any lease affecting the property, the existence or absence of defaults under or the effect or this sale upon the rights of any party under such lease. The Substitute Trustee shall make no warranty of title, express or implied, and will sell and convey the subject real property by Substitute Trustee's Deed only.
The substitute trustee may adjourn or postpone the aforementioned sale of real property by public announcement at such time and place of sale, and from time to time thereafter may postpone such sale by public announcement at the time and place fixed by the preceding postponement or subsequently noticed sale, and without further notice make such sale at the time fixed by the last postponement, or may, in its discretion, give a new notice of sale. If applicable, the Notice requirements of T.C.A. § 35-5-117 have been met.
The failure of any high bidder to pay the purchase price and close the sale shall, at the option of the Substitute Trustee, be cause for rejection of the bid, and, if the bid is rejected, the Substitute Trustee shall have the option of making the sale to the next highest bidder who is ready, willing, and able to comply with the terms thereof. The proceeds derived from the sale of the property will be applied as provided for in said deed of trust.
