SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on May 16, 2003, Marshall Smith, Jr. and Louise Smith executed a Deed of Trust to Prestige Title, Inc., Trustee for the benefit of Cimarron Mortgage Company d/b/a The Mortgage Warehouse, which is recorded in Book 5794 at Page 436 as Instrument No. 826277 in the office of the Chancery Clerk of the First Judicial District Hinds County, Mississippi; and
WHEREAS, the Deed of Trust was last assigned to Bandit Capital LLC by instrument recorded in the office of the aforesaid Chancery Clerk in Book 7322 at Page 7476 as Instrument No. 1909826; and
WHEREAS, Underwood Law Firm PLLC has been substituted as Trustee under the Deed of Trust; and
WHEREAS, default has been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby has been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, Bandit Capital LLC, has requested the undersigned Substituted Trustee to execute the trust and sell the property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with attorney's fees, Substituted Trustee's fees, and expenses of sale.
NOW, THEREFORE, Underwood Law Firm PLLC, as Substituted Trustee under the Deed of Trust, will on January 16, 2026, offer for sale at public outcry to the highest bidder for cash within legal hours (between 11:00 a.m. and 4:00 p.m.) at the north front door of the Hinds County Courthouse (First Judicial District) in Jackson, Mississippi, the following described property together with all improvements thereon situated in the First Judicial District Hinds County, Mississippi, being the same property described in the Deed of Trust:
Beginning at the SW Corner of the SE 1/4 of the NW 1/4 of Section 34, T6N, R1W and running South 711.8 feet to the Point of Beginning. Thence Continuing South 113.2 feet; thence East for 328 feet to the centerline of a road; thence North along said centerline for 113.2 feet; thence West 328 feet to the Point of Beginning. Said parcel being in the NE 1/4 of the SW 1/4 of Section 34, T6N, R1W, First Judicial District, Hinds County, Mississippi; being the same lands conveyed by Emma Jenkins by deed recorded in the Office of the Clerk of the Chancery Court of Hinds County at Jackson, Mississippi, in Deed Book 1742, Page 376 reference to which is hereby made for a greater certainty of description and deraignment of title.
UNDERWOOD LAW FIRM PLLC will convey only such title as is vested in it as Substituted Trustee.
