SUBSTITUTED TRUSTEE'S NOTICE OF SALE
WHEREAS, on June 13, 2022, VCP Southbrook Gardens LLC, as Grantor, executed a Deed of Trust to Stewart Title, as Trustee for the benefit of Merchants Bank of Indiana, as Lender and Beneficiary, which is recorded in Book 7282 at Page 3378 in the office of the Chancery Clerk of the First Judicial District of Hinds County, Mississippi; and
WHEREAS, Merchants Bank of Indiana assigned all its rights, title, and interest in and to the Deed of Trust together with the indebtedness secured thereby to Hartford Magnolia LLC pursuant to an Assignment of Deed of Trust dated January 9, 2026, and recorded on January 15, 2026, in Book 7327 at Page 2447 in the office of the aforesaid Chancery Clerk; and
WHEREAS, Hartford Magnolia LLC appointed and substituted Underwood Law Firm PLLC as Trustee under the Deed of Trust pursuant to a Substitution of Trustee dated February 9, 2026, and recorded on February 20, 2026, in Book 7330 at Page 6976 in the office of the aforesaid Chancery Clerk; and
WHEREAS, default has been made in the terms and conditions of the Deed of Trust and the entire debt secured thereby has been declared due and payable in accordance with the terms of the Deed of Trust, and the legal holder of the indebtedness secured thereby, Hartford Magnolia LLC, has requested the undersigned Substituted Trustee to execute the trust and sell the property in accordance with the terms of the Deed of Trust for the purpose of raising the sums due thereunder together with attorney's fees, Substituted Trustee's fees, and expenses of sale.
NOW, THEREFORE, Underwood Law Firm PLLC, as Substituted Trustee under the Deed of Trust, will on March 31, 2026, offer for sale at public outcry to the highest bidder for cash within legal hours (between 11:00 a.m. and 4:00 p.m.) at the north front door of the Hinds County Courthouse (First Judicial District) in Jackson, Mississippi, the following described property together with all improvements situated thereon, being the same property described in the Deed of Trust, subject to the senior Deed of Trust described below:
All that certain lot, piece or parcel of land, with the buildings and improvements thereon erected, situate, lying and being in the City of Jackson, County of Hinds, State of Mississippi.
Being situated in the Northeast ¼ of Section 29, Township 5 North, Range 1 East City of Jackson, Hinds County, Mississippi, and being more particularly described by metes and bounds as follows, to wit:
Commence at the northeast corner of Lot 3 Block A of East Leavell Woods Subdivision, the map or plat of which is recorded in Plat Book 11 at Page 23 of the Chancery Records of Hinds County at Jackson, Mississippi, said northeast corner being the Point of Beginning for the parcel herein described; thence North 89 degrees 13 minutes 21 seconds West for a distance of 126.0 feet along the northern line of the said East Leavell Woods Subdivision to the southeast corner of Lot 13 of Harreldar Heights, a subdivision, the map or plat of which is recorded in Plat Book 10 at Page 49 of the said Chancery Records of Hinds County at Jackson, Mississippi; thence North 00 degrees 37 minutes 25 seconds East for a distance of 400.0 feet along the eastern line of said Harreldar Heights; thence leave said eastern line of Harreldar Heights and run South 89 degrees 22 minutes 35 seconds East for a distance of 126.0 feet; thence North 00 degrees 37 minutes 25 seconds East for a distance of 210.26 feet to the southern right of way line Daniel Lake Boulevard; thence North 83 degrees 53 minutes 12 seconds East for a distance of 170.70 feet along the said southern right of way line; thence leave said southern right of way line of Daniel Lake Boulevard and run South 00 degrees 25 minutes 25 seconds West for a distance of 627.74 feet; thence South 89 degrees 10 minutes 47 seconds East for a distance of 465.0 feet; thence South 00 degrees 49 minutes 13 seconds West for a distance of 272.0 feet; thence South 89 degrees 36 minutes 58 seconds West for a distance of 621.79 feet to the eastern line of East Leavell Woods Subdivision; thence North 02 degrees 14 minutes 21 seconds West for a distance of 282 feet along the said eastern line of East Leavell Woods Subdivision to the Point of Beginning, containing 7.6011 acres, more or less.
NOTE FOR INFORMATION: Being Parcel No. 610-16-4, of the City of Jackson, County of Hinds.
PLEASE TAKE NOTICE that the above-described property will be sold "as is, where is" without representations or warranties of any kind and subject to any and all prior or superior liens, claims, and encumbrances, including without limitation that certain Deed of Trust recorded in Book 7282 at Page 3339 in the office of the aforesaid Chancery Clerk, which is a valid and subsisting first lien against the property. The current beneficiary of the Deed of Trust being foreclosed herein, Hartford Magnolia LLC, is also the holder of the aforesaid senior Deed of Trust. No merger of title or lien is intended, and the senior Deed of Trust shall remain a valid, prior, and enforceable lien against the property following the foreclosure sale.
PLEASE TAKE FURTHER NOTICE that Hartford Magnolia LLC, as assignee of the rights and remedies of Merchants Bank of Indiana as Lender under the two Deeds of Trust described herein, is authorized to conduct the foreclosure sale scheduled herein pursuant to Paragraph 6 on Page 10 of that certain Order Appointing Receiver (Dkt. #17) entered on February 13, 2025, by the Chancery Court of the First Judicial District of Hinds County, Mississippi, in the matter of Merchants Capital Corp., in its capacity as servicer on behalf of Merchants Bank of Indiana v. VCP Southbrook Gardens, LLC, Case No. 24-cv-01475.
UNDERWOOD LAW FIRM PLLC will convey only such title as is vested in it as Substituted Trustee without warranty of any kind, express or implied.
