To the above-named Defendant(s): ICAR JOHN SIMON SR., deceased, his heirs at law, next of kin and distributees whose names and places of residence are unknown, and if he died subsequent to the decedent herein, to his executors, administrators, legatees, devisees, assignees and successors in interest whose names and places of residence are unknown and cannot, after diligent inquiry, be ascertained MADELINE BOLIS, if living and if dead to her heirs at law, next of kin and distributees whose names and places of residence are unknown, and if she died subsequent to the decedent herein, to her executors, administrators, legatees, devisees, assignees and successors in interest whose names and places of residence are unknown and cannot, after diligent inquiry, be ascertained EDNA MIGALA, if living and if dead to her heirs at law, next of kin and distributees whose names and places of residence are unknown, and if she died subsequent to the decedent herein, to her executors, administrators, legatees, devisees, assignees and successors in interest whose names and places of residence are unknown and cannot, after diligent inquiry, be ascertained NELLIE MASSAD, if living and if dead to her heirs at law, next of kin and distributees whose names and places of residence are unknown, and if she died subsequent to the decedent herein, to her executors, administrators, legatees, devisees, assignees and successors in interest whose names and places of residence are unknown and cannot, after diligent inquiry, be ascertained YOU ARE HEREBY SUMMONED to answer the complaint in this action and to serve a copy of your answer, or, if the complaint is not served with this summons, to serve a notice of appearance, on the Plaintiff's attorney within twenty (20) days after the service of this summons, exclusive of the day of service (or within thirty (30) days after service is complete if this summons is not personally delivered to you within the State of New York), and in case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint. This Summons is served upon you by publication pursuant to an Order of the Supreme Court, Cattaraugus, dated January 8, 2026, entered January 9, 2026, which directed that service be made upon you by publication, in accordance with CPLR 316. The publication shall be made in Olean Times Herald, Detroit Free Press, and Ocala Star Banner, once in each of four consecutive weeks, and service shall be deemed complete on the twenty-eighth day after the first publication. Defendant is not an infant or incompetent (upon information and belief). The basis of venue is that the property which is the subject of this action is located in Cattaraugus County, New York. (CPLR §507) The nature of this action is to quiet title to real property located at 314 N. Eighth St., Olean, NY 14760, and such other relief as the Court deems just and proper.
