U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR LEGACY MORTGAGE ASSET TRUST 2021-GS2, Plaintiff, -against- EDDY PETION, SUFFOLK FEDERAL CREDIT UNION, "JOHN DOE 1 to JOHN DOE 25", said names being fictitious, the persons or parties intended being the persons, parties, corporations or entities, if any, having or claiming an interest in or lien upon the mortgaged premises described in the complaint, INDEX NO.: 625316/2024 FILED:10/10/2024 Defendants. TO THE ABOVE-NAMED DEFENDANTS: YOU ARE HEREBY SUMMONED to answer the complaint in this action, and to serve a copy of your answer, or, if the complaint is not served with this summons, to serve a notice of appearance on the plaintiff's attorney within 20 days after the service of this summons, exclusive of the day of service or within 30 days after completion of service where service is made in any other manner than by personal delivery within the State. In case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint. NOTICE OF NATURE OF ACTION AND RELIEF SOUGHT THE OBJECT of the above captioned action is to foreclose a Mortgage in the amount of $512,167.00 recorded in the Suffolk County Clerk's/City Register's Office on May 5, 2008 in Liber 21703 of Mortgages at Page 328 covering the premises known as 54 3RD STREET, WEST ISLIP, NY 11795. The loan was then modified by a Loan Modification Agreement dated April 30, 2009. Thereafter, the loan was then modified by a Loan Modification Agreement dated December 14, 2011. Thereafter, the Mortgage was assigned to BAYVIEW LOAN SERVICING, LLC, by an Assignment of Mortgage dated August 13, 2013 and recorded with the Suffolk County Clerk on December 30, 2013, in Liber 22443 at Page 307. The loan was then modified by a Loan Modification Agreement dated September 7, 2016 and recorded with the Suffolk County Clerk on September 21, 2016, in Liber 22739 at Page 73. The loan was then modified by a Loan Modification Agreement dated September 7, 2016 and recorded with the Suffolk County Clerk on September 21, 2016, in Liber 22739 at Page 74. The Mortgage was then assigned to BAYVIEW DISPOSITIONS IIIB, LLC, by an Assignment of Mortgage dated July 9, 2018 and recorded with the Suffolk County Clerk on September 27, 2018, in Liber 22963 at Page 749. The Mortgage was then assigned to 1900 CAPITAL TRUST II, BY U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS CERTIFICATE TRUSTEE, by an Assignment of Mortgage dated July 9, 2018 and recorded with the Suffolk County Clerk on December 10, 2018, in Liber 22987 at Page 245. The Mortgage was then assigned to GOLDMAN SACHS MORTGAGE COMPANY, by an Assignment of Mortgage dated February 2, 2021 and recorded with the Suffolk County Clerk on March 2, 2021, in Liber 23239 at Page 904. The Mortgage was further assigned to U.S. BANK TRUST NATIONAL ASSOCIATION, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUTEE FOR LEGACY MORTGAGE ASSET TRUST 2021-GS2, by an Assignment of Mortgage dated June 22, 2022 and recorded with the Suffolk County Clerk on August 15,2022, in Liber 23447 at Page 663. The loan was further modified by a Loan Modification Agreement dated June 8, 2022 and recorded with the Suffolk County Clerk on July 31, 2023, in Liber 23524 at Page 81. The relief sought in the within action is a final Judgment of Foreclosure and Sale directing the sale of the premises described above to satisfy the debt secured by the Mortgage described above. Suffolk County is designated as the place of trial on the basis of the fact that the real property affected by this action is located wholly within said County. NOTICE YOU ARE IN DANGER OF LOSING YOUR HOME If you do not respond to this summons and complaint by serving a copy of the answer on the attorney for the mortgage company who filed this foreclosure proceeding against you and filing the answer with the court, a default judgment may be entered and you can lose your home. Speak to an attorney or go to the court where your case is pending for further information on how to answer the summons and protect your Property. Sending a payment to your mortgage company will not stop this foreclosure action.
