NOTICE TO ABSENT DEFENDANT:
UNKNOWN OWNER(S) OF THE "GORE AREA" LOCATED EAST OF PARK AVENUE IN THE TOWNSHIP OF WEEHAWKEN
1. YOU HAVE BEEN NAMED AS A DEFENDANT in a condemnation action filed in the Superior Court of New Jersey, Law Division, Hudson County, in which the New Jersey Transit Corporation ("NJ Transit") is the plaintiff and the City of Hoboken, et al. are the defendants. The action seeks to acquire by eminent domain for public use, for NJ Transit purposes, either a fee simple or lesser interest, or both, in the lands and premises, situate, lying and being in the Township of Weehawken and City of Hoboken in the County of Hudson, and State of New Jersey, being known as the "Gore Area" east of Park Avenue, and identified as Block 34.03, Lot 2.05 on the tax map of the Township of Weehawken. YOU ARE BELIEVED TO BE THE OWNER OF THIS PROPERTY OR HAVE OR MAY CLAIM TO HAVE SOME RIGHT, TITLE, OR OTHER INTEREST IN THIS PROPERTY.
2. YOU ARE ADVISED THAT a commissioners' hearing has been scheduled for July 29, 2026 at 10:00 a.m. at Riker Danzig LLP, 7 Giralda Farms, Suite 250, Madison, NJ 07940. You are entitled to appear at this hearing. The purpose of this hearing is to determine the amount of just compensation due to the owner of the above-referenced land and premises as a result of the taking identified in the Verified Complaint. You are entitled to appear at this hearing personally or through counsel. Failure to appear at this hearing personally or through counsel will result in loss of certain legal rights, including the right to appeal the award of the Commissioners which award shall become final.
3. YOU ARE ADVISED THAT AN ORDER FOR PAYMENT INTO COURT FOR THE VESTING OF TITLE AND FOR POSSESSION has been issued by the Honorable Anthony V. D'Elia, J.S.C., and that Plaintiff New Jersey Transit Corporation has caused the estimated amount of just compensation to be deposited with the Superior Court Trust Fund.
4. YOU ARE FURTHER ADVISED THAT A DECLARATION OF TAKING has been recorded with the County of Hudson Register of Deeds and Mortgages granting NJ Transit title to the property in easement for the property specifically described in the Declaration of Taking and exhibits thereto.
