SUPERIOR COURT OF NEW JERSEY: LAW DIVISION - OCEAN COUNTY DOCKET NO.: OCN- L- 1005-26 NOTICE TO ABSENT DEFENDANT TO: NATHAN WEISS TAKE NOTICE that Plaintiff, PKN Development, LLC has filed a Complaint against you, Nathan Weiss, in the Superior Court of New Jersey, Law Division, Ocean County, Docket No. OCN-L-1005-26. The Complaint asserts claims for trespass, ejectment and quiet title. Plaintiff alleges it owns real property known as 312 Atlantic City Avenue, Berkeley Township, New Jersey (Block 1067, Lot 9.02) and that you, Nathan Weiss, own the adjacent property known as 314 Atlantic City Avenue, Berkeley Township, New Jersey (Block 1067, Lot 13). Plaintiff alleges a fence constructed and/or maintained by you encroaches onto Plaintiff's property by approximately 1.8 to 2.6 feet for a distance of approximately 40 to 50 feet along the shared boundary. Plaintiff seeks among other relief (1) an order directing you to remove the encroaching fence and any other improvements from Plaintiff's property and to restore the property to its original condition; (2) a judgment declaring Plaintiff's title to the encroached upon area to be in fee simple and that you have no right, title or interest therein; (3) compensatory damages; (4) attorney's fee and costs of suit; and (5) such other and further relief as the Court deems just and equitable. Plaintiff has also requested a trial by jury. Unless you file and serve a written answer or motion in response to the Complaint within 35 days after publication of this Notice the Court may enter a judgment against you for the relief Plaintiff demands in the Complaint, plus interest and costs of suit. If a judgment is entered against you, the Sheriff may seize your money, wages, or property to pay all or part of the judgment. You must also send a copy of your answer or motion to Plaintiff's attorney whose name and address appear below.
