Shaw Mines Refuse Site
PUBLIC NOTICE
Pursuant to the Surface Mining Conservation and Reclamation Act, the Clean Streams Law, the Coal Refuse Disposal Control Act, as amended, and the Pennsylvania Department of Environmental Resources Rules and Regulations, notice is hereby given that Simkol Corporation, 1281 Rubright Road, Rockwood, PA 15557 has made application to the Bureau of District Mining Operations, California District Mining Office, 25 Technology Drive, Coal Center, PA 15423, to transfer the existing CRDP #56180701, known as the Shaw Mines Refuse Site, and related NPDES permit, from Heritage Coal & Natural Resources, LLC, 622 Central Avenue, Johnstown, PA 15902. The center of the 131.0 acre permit is located in Summit and Elk Lick Townships, Somerset County,
approximately 7.3 inches north and 9.0 inches west of the bottom right-hand corner of the printed area of the U.S.G.S. 7 ½' Meyersdale quadrangle map. The permit area is located west of the Casselman River and begins at the intersection of T-825, Shaw Mines Road and T-502 Skyline Drive, approx.. 3,500' southwest of the area known locally as Shaw Mines. The permit boundary then extends southeast approx. 1,000' along T-502, Skyline Drive, turns and extends southwest for a distance of approx. 1,500', turns and extends northwest for a distance of approx. 3,200', turns and extends northeast for a distance of approx. 1,500' to T-825, Shaw Mines Road and then follows T-825 to the east-southeast for a distance of approx. 2,200' to the point of beginning.
The permit also includes a request for variances on the 100' barriers of T-825 Shaw Mines Road and T-502 Skyline Drive. The variance area on T-825 will begin approx. 450' east of its intersection with T-499, Bird Farm Road, at the point where T-825 crosses the Summit/Elk Lick Twp. Line, and will extend to the south and east along either side of the road a distance of approximately 5,000 feet. The variance on T-502 will begin at its intersection with T-825 and extend to the southeast on either side of the road a distance of approximately 1,350 feet. This approval will permit mining activities associated with the construction and operation of a coal refuse disposal site, and will include the placement of erosion control ditches along the southern edges of both roads.
Simkol Corporation will continue to operate a coal refuse disposal site and will discharge from two outfalls to Unnamed Tributary 39266 to the Casselman River. The 001 discharge of treated water from the coal refuse disposal area will occur at Lat. 39-47-30.3 & Long. 79-03-39.7. The 002 discharge of storm water will occur at Lat. 39-47-26 & Long. 79-03-46. The application, plans, and other data concerning this transfer have been placed on file for public review at the above listed office of the Bureau of District Mining Operations. Anyone wishing to submit comments or requests for an informal conference concerning this application for transfer should write to the above listed Bureau of District Mining Operations address within thirty (30) days of the final publication of this notice stating his or her name, address, telephone number, and the nature of their comment. This application is made in accordance with the provisions of the Act of June 22, 1937, P.L., 1987, as amended.
