IN THE MATTER OF THE GUARDIANSHIP OF CARLIE RAY BRETZ and MADALINE RENEE BRETS, minor children.
ORDER APPOINTING TEMPORARY EMERGENCY GUARDIAN
This matter came on for consideration before me, the undersigned Judge of the District Court, upon the Petition for Temporary Emergency Guardianship filed September 25, 2025, by Petitioner, Christopher Marks, to be appointed to serve as temporary emergency guardian of the person and property of Carlie Ray Bretz, born October 6, 2007 and Madaline Renee Bretz, born October 13, 2008. Petitioner appeared before the Court and was represented by his attorney of record, John M. Dunn of the Law Offices of John Dunn, PLLC. Neither Natural Mother nor Natural Father nor current Guardian appeared before the Court. The Court, upon review of the files and pleadings in this case, having heard Petitioner's testimony, having heard counsel's presentation, and being otherwise fully advised, FINDS & ORDERS:
1. That Petitioner is to be appointed temporary emergency guardian of the person and property of Carlie Ray Bretz and Madaline Renee Bretz (hereinafter, "the Children"), and he is awarded sole legal care, custody, and control of the Children until further Order of the Court. This appointment shall be effective from and after the temporary emergency guardian executes the oath required by law.
2. That a Show Cause hearing shall be held on 10/27/2025 at 10:30 a.m. in Courtroom 203 of the District Court of Osage County, 600 Grandview Avenue, Pawhuska, Oklahoma, 74056.
3. That Natural Mother, Natural Father, and current Guardian shall be provided notice of said hearing in a timely manner.
4. That, pursuant to 30 OS § 4-201(B)(2), the Court waives posting of a guardian's bond in this case because the Children's anticipated annual income plus the value of their personal property is substantially less than forty-thousand dollars ($40,000.00).
5. That, pursuant to 30 OS § 4-303(B), this Court waives the filing of the annual guardianship plan for the property of the Children, until further Order of this Court, because the Children's estate is worth substantially less than ten-thousand dollars ($10,000.00).
