SPEARS, Defendant __________________________________________ To the defendant: YOU ARE HEREBY SUMMONED to answer the complaint in this action and to serve a copy of your answer on the plaintiff's attorneys within twenty (20) days after the service of this summons, exclusive of the day of service (or within thirty (30) days after the service is complete if this summons is not personally delivered to you within the State of New York). In case of your failure to appear or answer, judgment will be taken against you by default for the relief demanded in the complaint. This summons is an attempt to collect a debt and any information obtained will be used for that purpose. IMPORTANT NOTICE: Despite the requirement in this summons that you answer the complaint you may still dispute the claims made against you in the complaint and you have thirty (30) days from the date you receive this summons and complaint, exclusive of the date of receipt, to dispute the validity of the claims. Please be advised that unless, within that time limit, you dispute the validity of the claims or any portion thereof, these claims will be assumed by us to be valid. If you notify us within this thirty (30) day period that these claims or any portion thereof are disputed, we will obtain verification of the claims and send it to you. If you dispute the claims your time to answer the complaint will be extended until thirty (30) days after we send the verification to you. Any information we obtain will be used for the purpose of collecting the claims we are asserting against you in the complaint. NATURE OF THE ACTION AND RELIEF SOUGHT: The Defendant has overdrawn their checking (share) account held by the plaintiff. Plaintiff demands judgment against the defendant for principal sum of $5,542.40, with interest as allowed by law, reasonable attorneys' fees, costs, and disbursements.
