NOTICE OF PUBLIC HEARING
PLEASE TAKE NOTICE that on July 13, 2026 at 6:00 P.M., a public hearing will be held before the Township of Guttenberg Planning Board (the "Planning Board") at the Town Hall, Municipal Chambers located at 6808 Park Avenue, Guttenberg, NJ 07093. At that time, Spark Ave LLC ("Applicant") will seek Preliminary and Final Site Plan Approval and Conditional Use Approval, with associated design waivers, and, only to the extent the Board determines relief is necessary, D(3) conditional use variance relief, to permit a Class 5 Cannabis Retailer with an accessory co-located Class 2 Cannabis Manufacturer at the subject premises commonly known as 6802 Park Avenue, Guttenberg, Hudson County, New Jersey, otherwise known as Block 34, Lot 2, as indicated on the Township's Tax Assessment Map (the "Property").
The Property is located in the C Commercial Zone. Class 5 Cannabis Retail and Class 2 Cannabis Manufacturing facilities are permitted to operate in the C Commercial Zone as a conditional use. The proposed improvements at the site consist primarily of interior fit-out, security enhancements, ventilation and odor-control systems, life-safety and code-compliance improvements, and associated signage. The Applicant is requesting waivers for lighting plan, grading plan and drainage/stormwater management report, landscaping plan, underground utility locations and utility-extension details (partial wavier requested), traffic circulation/parking study and any other checklist waivers for submission items unnecessary to evaluate a no-exterior-work, existing-building conditional use application. In addition, and without limitation, the Applicant may also seek any other approvals, variances, waivers, and exceptions as may arise or be deemed necessary by the Township's officials, as well as such other approvals, variances, waivers, and exceptions that may arise during the public hearing.
On the hearing date, the Planning Board will review and take formal action upon the Application. Any interested party may appear either in person, or by agent or attorney, and present any facts or objections which they may have relative to the granting of this Application.
The Application and supporting materials, including maps and plans, will be available for public inspection at least ten (10) days prior to the scheduled public hearing at the Planning Board's offices located at 6808 Park Avenue, Guttenberg, New Jersey 07093, Monday through Friday 8:30 a.m. to 4:00 p.m. Members of the public may contact the Board Secretary at (201)868-2315 ext. 189, or by email at avaldez@myguttenberg.com, to make an appointment to review the Application materials or for additional information.
