ZONING BOARD OF ADJUSTMENT
PLEASE TAKE NOTICE that a Zoning Board of Adjustment Hearing is scheduled for Tuesday November 4, 2025 at 6:30 PM in the MAIN MEETING ROOM at the Township of Hanover Municipal Building located at 1000 Route 10 West and North Jefferson Road in Whippany, New Jersey 07981 at which time the Township of Hanover Zoning Board will consider Application BOA #1910 as follows:
1. Name of Applicant is Paul and Jamella Elias, h/w.
2. Property to which the Application applies is 7 Adela Court, Whippany, NJ.
3. Property is also known as Lot 11.03 in Block 4605.
4. Property is a pre-existing Non-Conforming Lot as defined in Township of Hanover Code, Chapter 166 entitled Land Use and Development at §4 and is located in the R-15 Zone.
5. The nature of the Application is for Minor Site Plan with variances to construct an attached garage and convert the interior space where the garage was located into habitable space. The garage addition requires a setback variance for the side yard, variance to exceed floor area ratio for the additional habitable space, variances for lot coverage and building coverage, and relief from the condition of a prior 2005 Resolution for subdivision approval that required a 35 foot side yard and 11 feet is proposed. One tree to be removed. The existing house has pre-existing non-conforming front yard setback and lot frontage which will not be modified by this Application.
6. The relief sought:
Variances from the Township of Hanover Code, Chapter 190 entitled Land Use Development §166-171:
(a) § 166-171 (E) (7&8) requires a minimum of 35 feet for a side yard setback to the property line and the Applicant is seeking to provide 11 feet. Variance for 24 feet for the side yard setback is requested.
(b) § 166-171 (E) (12) allows a maximum of 24% for floor area ratio and the Applicant is seeking to provide 28.27%. Variance for 4.27% in additional Floor Area Ratio is requested.
(c) § 166-171 (E) (13) allows a maximum of 18% for Building Coverage and the Applicant is seeking to provide 20.5%. Variance for 2.5% in additional Building Coverage is requested.
(d) § 166-171 (E) (14) allows for Improvement Coverage. The Improvement Coverage is 5,753 SF and the Applicant is seeking to provide 5,932 SF. Variance for 179 SF or 1.1% in additional Improvement Coverage is requested.
(e) § 166-91,92,103 &104 -Waiver from the Design Standards as the property is located in a pre-existing subdivision and the site is not being changed except for the requested construction of a garage.
(f) § 166-215 & 216 as the variances and relief requested may impact the map regulations to show garage.
In addition, relief and/or waiver from the conditions of a prior subdivision approval for application 04-10-12 granted on May 16, 2005 with a memorializing resolution on June 21, 2005 that required at Paragraph 3 for the side yards from the house to the property line to be 35 feet on one side and 20 feet on the other side.
Applicant shall also seek such other relief, permits, variances, waivers and/or exceptions which may become evident during the Hearing and necessary for approval of the proposed construction.
When the case is called, you may appear in person or by an attorney, at which time you may question the Applicant's witnesses and/or present any testimony which you may have concerning the Application.
All documents relating to this Application can be inspected in the Land Use Department, Township of Hanover Municipal Building, 1000 Route 10 and North Jefferson Road, Whippany, NJ between 9 AM and 4 PM Monday through Friday.
