TOWNSHIP OF MAPLE SHADE ORDINANCE 2025-17 AN ORDINANCE OF THE TOWNSHIP OF MAPLE SHADE, COUNTY OF BURLINGTON, STATE OF NEW JERSEY AMENDING CHAPTER 4, ARTICLE IX § 4-42(F) OF THE TOWNSHIP CODE WHEREAS, the Township Manager and Director of Business and Economic Development have reviewed the provisions of the Township Code at §4-42, specifically Subsection F entitled "Meetings," and finds it necessary and appropriate to amend said subsection in order to clarify procedures, ensure consistency with current practices, and better serve the public interest; and WHEREAS, the Business and Economic Development Commission Members have discussed the need to amend the meeting schedule set forth in Subsection F to better align with the Commission's work plan and availability; and WHEREAS, at the recommendation of the Director of Community Development, it is further determined that in the event a Commission Member has four (4) unexcused absences within a calendar year, the Commission may request that such Member tender their resignation or, in the alternative, recommend a replacement to the Mayor for appointment subject to Council approval; NOW, THEREFORE, BE IT ORDAINED by the Township Council of the Township of Maple Shade, County of Burlington, State of New Jersey, that the Code of the Township of Maple Shade is hereby amended at §4-42, Subsection F "Meetings," to read as follows: §4-42 BUSINESS AND ECONOMIC DEVELOPMENT COMMISSION F. Meetings. Schedule. The Commission shall meet at least 6 times a year. The time and place of the bi-monthly meetings shall be fixed annually by resolution of the Commission. Notice of the annual schedule and of any special or additional meetings shall be made to the public pursuant to the Open Public Meetings Act. Any cancellation or change of meeting shall be made by the Executive Committee. Commissioners will be notified at least 48 hours in advance.Open meetings. The meetings of the Commission shall be open to the public unless it is determined by the Chair of the Commission, or by a majority of the members, that a closed session is required to discuss any of the following categories or matters: Any matter involving the purchase, lease or acquisition of real property with public funds where said purchase or lease could adversely affect the public interest if discussion of such matters were disclosed;Any matter of pending or anticipated litigation;Any matter of contract negotiations; Any matter falling within the attorney/client privilege; andAny matter involving the potential employment, appointment, termination or employment, terms and conditions of employment, evaluation of performance, promotion or disciplining of any specific public officer, employee and/or consultant.Quorum. A majority of the voting members of the Commission shall constitute a quorum for the transaction of business.Absence from meetings. All regular members are expected to attend all meetings. When a member has exceeded three (3) unexcused absences, the Commission may request the resignation and recommend a replacement to the Mayor for approval by the Council. When a member has exceeded four (4) unexcused absences within a calendar year, the Commission may request the resignation of the member and/or recommend a replacement to the Mayor for approval by Council. Section 2. All ordinances or parts of ordinances inconsistent herewith are hereby repealed to the extent of such inconsistency. Section 3. If any section, subsection, paragraph, subsection or provision of this Ordinance shall be held to be invalid or unconstitutional, such decision shall not affect the remaining portions of this Ordinance. Section 4. This Ordinance shall take effect immediately upon final adoption and publication according to law. NOTICE OF INTRODUCTION The foregoing ordinance was introduced at a meeting of the Maple Shade Township Council, held on September 18, 2025, and was read for the first time. This ordinance will be further considered for final passage at a Regular Meeting of the Township Council to be held on October 16, 2025, at 6:30 P.M. at 200 Stiles Avenue, Maple Shade, NJ 08052. Copies of this ordinance will be made available on the township website at: www.mapleshade.com and at the Municipal Clerk's office to members of the general public who request same during normal operating hours.
