NOTICE OF HEARING
Pursuant to N.J.S.A. 40:55D-12
PLEASE TAKE NOTICE that the Planning Board of the Township of Ocean ("Board") will hold a public hearing on Monday, March 23, 2026 at 7:00 p.m. in the Public Meeting Room, First Floor, Municipal Building, 399 Monmouth Road, Oakhurst, New Jersey to consider the application of Bio Investment Group LLC ("Applicant") for premises known as Lots 5, 29, 30 and 31 in Block 33.13 as shown on the Official Tax Map of the Township of Ocean and located at 12 Klein Street (Lot 5); 702 West Park Avenue (Lot 29); 704 West Park Avenue (Lot 30); and, 706 West Park Avenue (Lot 31), Ocean, New Jersey (collectively "Property").
Lot 5 is located in the Township's R-4 Medium Density Single-Family Residential Zone District ("R-4 Zone") and contains a one-story single-family dwelling, driveway on Klein Street, and related site improvements. Lots 29, 30 and 31 are located in the Township's T-1 Transitional Office/Residential Zone District ("T-1 Zone"). Lot 29 contains a two-story structure with driveway on West Park Avenue, detached garage, and related site improvements. Lot 30 is currently vacant. Lot 31 contains a two-story structure, one-story greenhouse, driveway to West Park Avenue, detached garage, and related site improvements.
Applicant seeks preliminary and final major site plan and subdivision approvals to subdivide Lots 29, 30, and 31 to create a total of eight (8) proposed lots (Proposed Lots A through H), and to construct a new roadway off of West Park Avenue to access the proposed lots, along with landscaping, lighting, drainage improvements, and related site improvements. The existing dwelling and improvements on existing Lot 29 are proposed to remain on Proposed Lot A. Proposed Lot E will contain only a stormwater infiltration basin and related improvements. Construction of new homes are not currently being proposed on Proposed Lots B, C, D, F, G, and H as part of this application, but rather, Applicant is seeking to create vacant building lots for future development of single-family homes on each. A drainage easement is proposed through existing Lot 5 in order to connect the proposed stormwater management system on the Property to the Township's existing drainage system located within the Klein Street right-of-way. No additional development is proposed on existing Lot 5 other than the stormwater management connection.
In conjunction with the application, Applicant seeks bulk variance relief pursuant to NJSA 40:55D-70.c as follows:
Proposed Lot A:
Front yard setback of 1.1 feet to the porch and 9.3 feet to the building façade of the existing house, whereas a minimum of 30 feet is required, and 16.1 feet and 24.6 feet exist. The existing house is not being altered; however, the proposed subdivision includes a 15 foot dedication of right of way along the West Park Avenue frontage to the County, which brings that front property line 15 feet closer to the existing house.
Proposed Lot C:
Lot width of 93.2 feet, whereas a minimum of 100 feet is required.
Proposed Lot D:
Lot width of 94.1 feet, whereas a minimum of 100 feet is required.
Proposed Lot E (Stormwater Basin Lot):
Lot area of 8,887 square feet, whereas a minimum of 10,000 square feet is required.Lot width of 48.4 feet, whereas a minimum of 100 feet is required.Lot depth of 61.7 feet, whereas a minimum of 100 feet is required.Lot frontage of 31.4 feet, whereas a minimum of 60 feet is required.
Proposed Lot F:
Lot width of 93.3 feet, whereas a minimum of 100 feet is required.
Proposed Lot H:
Lot width of 96.9 feet along frontage of proposed cul-de-sac road, whereas a minimum of 100 feet is required.Lot depth of 93 feet, whereas a minimum of 100 feet is required.
Applicant also seeks design waiver relief pursuant to NJSA 40:55D-51 for: cul-de-sac turnaround radius of 43 feet, whereas a minimum of 50 feet is required. The cul-de-sac radius complies with the state imposed Residential Site Improvements Standards, which ultimately govern.
Applicant also expressly makes application for any additional exceptions, waivers, variances, interpretations and other approvals as reflected on the filed plans (as same may be further amended from time to time without further notice) and as may be determined to be necessary by the Board during the review and processing of the application.
PLEASE TAKE FURTHER NOTICE that you are privileged to be present at said public hearing to present any and all comments you may have to the granting of said approvals. The hearing may be continued without further notice on such additional or other dates as the Board may determine. The application and supporting documents are on file in the Board office located in the Municipal Building, 399 Monmouth Road, Oakhurst, New Jersey and are available for inspection during the Township's normal business hours.
