ORDINANCE #1246-25
AN ORDINANCE ESTABLISHING POLICIES AND PROCEDURES FOR THE
RENTAL OF BILLBOARD DISPLAY FLIPS
WHEREAS, the Township of Rochelle Park desires to establish Policies and Procedures for the rental of Billboard Display Flips; and
WHEREAS, pursuant to a 2013 Settlement Agreement between the Township of Rochelle Park ("Township") and Allied Developers, LLC, the Township is entitled to the use of three (3) billboard display turns, defined as eight-second displays within a sixty-four (64) second cycle, consisting of one turn on each of the two sign faces on the Route 17 location and one turn on either the eastbound or westbound face of the Route 80 location, at the Township's choice; and
WHEREAS, the Township may use these turns for public service announcements, emergency notices, Township messaging, or for private advertisers as a lawful monetizing opportunity; and
WHEREAS, the Township Committee desires to establish policies, procedures, and rental rates for the lawful use of said billboard turns in a manner that ensures public benefit, transparency, and fairness.
NOW, THEREFORE, BE IT ORDAINED by the Township Committee of the Township of Rochelle Park, County of Bergen, State of New Jersey, as follows:
Section 1. Definitions
For purposes of this Ordinance, the following terms shall have the meanings set forth below:
"Flip" or "Turn" – An individual eight-second display within a rotating sequence of advertisements on a digital billboard face, appearing once every sixty-four (64) seconds.
"Cycle" – A consecutive four-week rental period for a flip/turn. Multiple cycles may be purchased in advance.
"Administrator" – The Township Administrator of Rochelle Park, or their designee, responsible for coordinating billboard rentals and approvals in consultation with the Township Committee.
Section 2. Allocation
The Township may rent only those billboard flips expressly allocated to it under the 2013 Settlement Agreement with Allied Developers, LLC. Nothing in this Ordinance shall be construed to expand or modify the Township's rights under said Agreement.
Section 3. Authorization
The Township is authorized to rent its allocated billboard flips for commercial, nonprofit, governmental, and other lawful purposes in accordance with this Ordinance.
Section 4. Priority of Use
Township public service announcements, emergency alerts, and community messaging shall have priority over all paid advertisements.
In the event of a conflict, Township use shall supersede paid use, with advertisers receiving appropriate make-up time as outlined in Section 5.
Section 5. Rental Terms and Schedule
Rates. Billboard flips shall be rented at the following rates, based on prevailing market rates for comparable locations in the region:

2. Payments. Payment shall be made in full prior to the start of each cycle, in a form acceptable to the Township's Chief Financial Officer and coordinated through the Township Administrator.
Emergency Preemption. The Township reserves the right to suspend or remove any paid advertisement in order to display emergency or public safety messaging deemed necessary by the Township. The Township Administrator, or their designee, shall determine when such an emergency has ended. In such cases, the affected advertisement shall be paused and resumed after the emergency messaging concludes, and the advertiser shall receive the full contracted time purchased. No refunds shall be issued for delays or interruptions due to emergency preemption.
Section 6. Administration
All applications to rent billboard flips shall be submitted to the Administrator.
The Administrator shall review applications for compliance with this Ordinance and may approve or deny applications, subject to the consent of the Township Committee.
The Administrator shall coordinate scheduling and placement of advertisements with the billboard operator on behalf of the Township.The Mayor shall designate a Billboard Liaison from among the members of the Township Committee. The Billboard Liaison shall report monthly at a Township Committee meeting on billboard usage, rentals, revenues, and any issues requiring Committee attention.
Section 7. Content Restrictions
Advertisements must comply with all applicable laws, regulations, and standards of decency.
The Township reserves the right to reject any advertisement that is false, misleading, defamatory, obscene, or otherwise inconsistent with public policy or community standards.
Section 8. Revenues
All revenues derived from billboard rentals shall be deposited into the Township's General Fund. Such revenues may only be appropriated by action of the Township Committee in accordance with law.
Section 9. Records
The Administrator shall maintain records of all billboard rental applications, approvals, denials, contracts, and revenues. Such records shall be available for public inspection in accordance with the Open Public Records Act (OPRA).
Section 10. Severability
If any section, subsection, clause, or provision of this Ordinance shall be adjudged invalid, such adjudication shall apply only to that portion and the remainder shall be deemed valid and effective.
Section 11. Effective Date
This Ordinance shall take effect upon final passage and publication as required by law.
NOTICE OF INTRODUCTION
NOTICE IS HEREBY GIVEN that Ordinance #1246-25, was introduced and passed on first reading at a meeting of the Township Committee of Rochelle Park, held on August 27, 2025 and ordered published in accordance with the law. Said Ordinance will be considered for final reading and adoption at a meeting held on September 10, 2025 at 7:00 PM, in the Township of Rochelle Park Municipal Building, at which time all persons interested will be given an opportunity to be heard concerning such Ordinance.
