ORDINANCE #1250-25
AN ORDINANCE TO AMEND CHAPTER 161 ENTITLED "STREETS AND SIDEWALKS" OF THE TOWNSHIP CODE OF THE TOWNSHIP OF ROCHELLE PARK, STATE OF NEW JERSEY
BE IT ORDAINED BY THE TOWNSHIP COUNCIL OF THE TOWNSHIP OF ROCHELLE PARK IN THE COUNTY OF BERGEN AND STATE OF NEW JERSEY, AS FOLLOWS:
WHEREAS, Chapter 161 of the Code of the Township of Rochelle Park sets forth all regulations governing Streets and Sidewalks in the Township of Rochelle Park; and,
BE IT ORDAINED, by the Mayor and Council of the Township of Rochelle Park, County of Bergen and State of New Jersey that those portions of the aforesaid set forth below are hereby amended as follows and that those portions of the Ordinance not set forth below shall remain unchanged.
ARTICLE II
Removal of Snow, Ice, Grass and Weeds
Ch. 161-9. Violations and penalties
Any violation of this article for Residential Properties shall be punishable as follows:
A. For the first offense in any calendar year, by a fine of $75.
B. For the second offense in any calendar year, by a fine of $150.
C. For the third offense in any calendar year, by a fine of between $250 and $500. A court appearance shall be mandatory for a third offense.
D. For the fourth offense, by a fine up to $1,000 and/or imprisonment for a term not exceeding 90 days, or any combination thereof. A court appearance shall be mandatory for a fourth offense.
E. If the owner of any property who is charged with violating this article chooses to enter a plea of guilty for a first, second or third offense, he/she shall be entitled to pay the fine without the necessity of a court appearance.
F. Separate violation. Except as otherwise provided, every day that the violations shall continue shall be deemed a separate violation.
G. This article may be enforced by the Department of Public Works, Health Department, Police Department, Building Department or Property Maintenance Department.
Any violation of this article for Commercial/Business Properties shall, upon conviction, be punishable as follows:
H. For the first offense in any calendar year, by a fine of $150.
I. For the second offense in any calendar year, by a fine of $200.
J. For the third offense in any calendar year, by a fine of between $300 to $500. A court appearance shall be mandatory for a third offense.
K. For the fourth offense, by a fine up to $1,500 and/or imprisonment for a term not exceeding 90 days, or any combination thereof. A court appearance shall be mandatory for a fourth offense.
L. If the owner of any property who is charged with violating this article chooses to enter a plea of guilty for a first, second or third offense, he/she shall be entitled to pay the fine without the necessity of a court appearance.

Severability. All provisions of this Ordinance are severable. If for any reason, any provision of this Ordinance is held to be invalid, the validity of the remainder of the Ordinance shall not be affected.
Effective Date. This Ordinance shall become effective upon final approval and publication, pursuant to law, and upon completion of all outstanding cases.
NOTICE OF INTRODUCTION
NOTICE IS HEREBY GIVEN that Ordinance #1250-25, was introduced and passed on first reading at a meeting of the Township Committee of Rochelle Park, held on September 24, 2025 and ordered published in accordance with the law. Said Ordinance will be considered for final reading and adoption at a meeting held on October 8, 2025 at 7:00 PM, in the Township of Rochelle Park Municipal Building, at which time all persons interested will be given an opportunity to be heard concerning such Ordinance.
