TOWNSHIP OF ROXBURY BOARD OF ADJUSTMENT
NOTICE OF PUBLIC HEARING
In compliance with the New Jersey Municipal Land Use Law, the General Ordinances of the Township of Roxbury and the Rules and Regulations of the Township of Roxbury Board of Adjustment:
PLEASE TAKE NOTICE that on the 8th day of June, 2026, at 7:00 p.m., a hearing will be held at the Council Chambers of the Township Municipal Building Municipal Building located at 1715 Route 46, Ledgewood, New Jersey on the application of the undersigned, City Wide Towing LLC at which time and place all interested persons will be given an opportunity to be heard.
Applicant seeks to occupy the subject property located at 940 Route 46, better known as Block 5301 Lot 3 in the B-2 HWY Business Zone, as office space and outdoor storage for their towing business. The existing commercial building on site will be utilized as office space and there will be outdoor storage of vehicles towed to the site which will be temporary until they are picked up or towed off the site to a junk yard. All outdoor storage will be on the existing pavement within the fenced enclosure to the side and rear of the existing building.
Applicant also seeks a D-1 Use Variance pursuant to N.J.S.A. 40:55D-70d(1) to operate a towing business on the property with an office and vehicle storage on the property, which is not permitted in the B-2 Zone.
Applicant also seeks a C Variance pursuant to N.J.S.A. 40:55D-70c:
Per § 13-7.2502D(10), parking, including aisles and driveways, shall be located no closer than five (5) feet to the side and rear building walls. The paved parking area is located zero (0) feet from the side and rear of the building.
Per § 13-7.816A, outdoor storage is prohibited within the front, side, and rear yard setbacks. The outdoor storage of vehicles is proposed in the side yard setback.
Per § 13-7.816B, outdoor storage shall be set back a minimum of 25 feet from the rear and side property line. The proposed outdoor storage area is set back 2.9 feet from the westerly side property line.
At the time of the filing, the Applicant identified no further relief that may be required under N.J.S.A. 40:55D-70(c) and N.J.S.A. 40:55D-70(d). However, the Applicant reserves the right to supplement this application and/or seek at the time of hearing such other approvals, interpretations, variances, exceptions, and/or waivers as may be requested or required by the applicant or the Board.
A copy of said application and documents are on file and available to the public at the Municipal Building at the office of the Board Secretary.
Any interested parties may appear at said hearing and participate therein in accordance with the Rules of the Board of Adjustment.
