ZONING BOARD OF ADJUSTMENT
NOTICE OF HEARING
TO WHOM IT MAY CONCERN:
In compliance with the pertinent provisions of the Township of West Milford Planning and Zoning Code, and the New Jersey Municipal Land Use Act, N.J.S.A. 40:55D-1 et seq., notice is hereby given that the undersigned has filed a timely appeal of the Zoning Officer's Zoning Violation Notice dated August 12, 2025, pursuant to N.J.S.A. 40:55D-72(a). The Notice of Appeal, filed on August 28, 2025, challenges the written determination and enforcement action set forth in Violation No. ZV-08-25-0315. In addition to the above referenced appeal, notice also is hereby given that a corresponding and/or related written application has been filed by the undersigned with the Township of West Milford Zoning Board of Adjustment seeking the following relief, all in the alternative: (1) a favorable ordinance interpretation pursuant to N.J.S.A. 40:55D-70(b) that the existing Cooperative Sober Living Residence (CSLR) constitutes a single housekeeping unit which is a single-family residential use of the property and therefore is a permitted use in the residential zoning district in which the property is situated; and/or (2) Use Variance Relief pursuant to N.J.S.A. 40:55D-70d(1) to permit the continued occupation of the single-family home as a CSLR within a residential zone; and/or (3) a Reasonable Accommodation in the conduct of the Board's interpretation of the zoning ordinance, and/or consideration of the alternative request for use variance relief, as required under the mandates of the Federal Fair Housing Act and the Americans with Disabilities Act; together with any and all other variances or waivers the Board may reasonably require in the exercise of its discretion and without further public notice. This application concerns property shown as Block 9703, Lot 4.05 on the Township of West Milford Tax Map, which property is located at 928 Union Valley Road, and is situated within the R-1 High Density Residential Zoning District.
Public hearing on the above-described appeal and corresponding application has been scheduled for June 23, 2026 at 7:00 p.m. located at the Town Hall, 1480 Union Valley Road, West Milford, NJ at which time and place any interested party (as defined in N.J.S.A. 40:55D-4) will have an opportunity to be heard.
All documents relating to this appeal and application may be inspected upon request at the office of the Planning Department of the Township of West Milford located at Town Hall, 1480 Union Valley Road, West Milford, NJ, between the hours of 8:30 a.m. to 4:30 p.m., Monday through Thursday, and 8:30 a.m. to 1:30 p.m. on Fridays. Please take further notice that the Board may, at its discretion, adjourn, postpone or continue said hearing from time to time and you are hereby notified that you should make diligent inquiry of the Board Office concerning such adjournments, postponements or continuations.
