Pursuant to the terms of a deed of trust dated August 4, 2023, in the original principal amount of $196,377.00, recorded in the Clerk's Office of the Circuit Court of the County of Dinwiddie, Virginia, as Instrument No. 202302025, and as modified by Loan Modification Agreement recorded on August 5, 2025, as Instrument No. 202502176, and as assigned to Noteholder by Assignment of Deed of Trust recorded on March 24, 2026, as Instrument No. 202600821, the property briefly described below will be offered for sale at public auction:
ALL that certain lot or parcel of land lying and being in Sapony District of Dinwiddie County, Virginia, and being designated as Lot 13, Block A, Section II, Lew Jones Village Subdivision according to a Plat dated July 19, 1974 and recorded in the Clerk's Office, Circuit Court, Dinwiddie County, Virginia, in Plat Book 9, Pages 84 & 85, to which plat reference is hereby made for a more particular description.
The sale will take place on July 6, 2026, at 10:00 a.m., at the front entrance to the building housing the Circuit Court of the County of Dinwiddie, located at 14008 Boydton Plank Road, Dinwiddie VA 23841. The undersigned reserves the right to suspend bidding and/or to adjourn the bidding prior to the completion of sale.
The property and the improvements thereon will be sold "AS IS" and without representation or warranties of any kind. The sale is subject to all liens, encumbrances, conditions, easements and restrictions, if any, superior to the mentioned deed of trust and lawfully affecting the property.
Terms: A deposit in the form of CERTIFIED FUNDS in the amount of $10,000.00 (CASH NOT ACCEPTED) or 10% of the successful bid, whichever is lower, is required of any bidder at the time of sale. Closing within fifteen (15) days of sale. If the payment of the balance does not occur within fifteen days of sale, the deposit shall be retained by the Trustee as liquidated damages. Time is of the essence. Trustee has no duty to obtain possession for purchaser. The risk of loss or damage to the property passes to the purchaser immediately upon conclusion of the Substitute Trustee's sale. Purchaser to pay all closing costs, including cost of Trustee's Deed. Sale subject to lender confirmation. The Trustee may file IRS Form 8300, and a successful bidder shall provide all required information and produce a Government Picture Identification Card.
