PUBLIC NOTICE
PLEASE TAKE NOTICE that the Zoning Board of Adjustment ("Board") of the Township of Berkeley will hold a public hearing on May 27, 2026, at 6:30 p.m., in the Town Hall Meeting Room, Berkeley Township Municipal Complex, 627 Pinewald-Keswick Road, Bayville, New Jersey 08721, for the purpose of reviewing and taking formal action upon the application ("Application") of Holy Temple Church of God In Christ ("Applicant") for variance relief concerning that certain property designated as Block 30, Lots 35, 36, 37, 38, 39, 40, 41, 42, 43, 44, and 45, with a street address of 84 First Avenue, Toms River, New Jersey (the "Property"). The Property is located within the MPRPD Manitou Park Rehabilitation (MPRPD) zone. Formal action may be taken.
Applicant is seeking variance relief to construct a greenhouse and related site improvements on the Property, consisting of an approximately 30-foot by 60-foot greenhouse structure with a height of approximately 18 feet, together with fencing, utility connections, and other ancillary improvements. Applicant is seeking a use variance pursuant to N.J.S.A. 40:55D-70(d) to permit the construction of an accessory greenhouse structure on vacant land in the absence of a principal structure, where (i) Section 35-3 of the Berkeley Township Land Use Ordinance defines an accessory structure as one that is subordinate to and located on the same lot as a principal use or structure, neither of which exists on the Property; and (ii) Section 35-89.2 of the Berkeley Township Zoning District Regulations restricts uses and structures to those permitted in the zone. Applicant is further seeking bulk variance relief pursuant to N.J.S.A. 40:55D-70(c) from Section 35-89.7 of the Berkeley Township Zoning District Regulations, which permits a maximum accessory structure height of 15 feet, whereas approximately 18 feet is proposed. Applicant also seeks any additional exceptions, waivers, variances, interpretations, de minimis exceptions, and other approvals reflected on the filed plans (as same may be further amended or revised from time to time without further notice) and as may be determined to be necessary during the review and processing of the Application.
When the Application is called, interested parties may appear at the hearing, or any adjournment thereof, either in person or by attorney, ask questions, present evidence, and offer statements or documentation that may be relevant to the Application. The hearing may be continued without further notice on such additional or other dates as the Board may determine.
The application, maps, plans and related supporting materials will be available for public inspection at least 10 days prior to the public hearing in the Office of the Board, Berkeley Township Municipal Complex, 627 Pinewald-Keswick Road, Bayville, New Jersey 08721, during regular business hours, which are typically Monday through Friday, 8:30 am to 4:00 pm.
