TRUSTEE'S NOTICE OF SALE
WHEREAS, Ephant Group – Friedman LLC, Ephant Group – Easten House LLC, and Shree Ganesh Hospitality LLC executed that certain Deed of Trust, Security Agreement and Fixture Filing, dated May 6, 2022, to Oliver D. Adams, Trustee, for the benefit of First Century Bank that is of record at Instrument No. 202205060084837 in the Knox County Register of Deeds Office, Tennessee, as the same may have been amended, modified, and/or restated from time to time (collectively the "Deed of Trust"); and
WHEREAS, the Deed of Trust secures that certain Note (as defined in the Deed of Trust); and
WHEREAS, by that certain Assignment of Loan and Loan Documents of record at Instrument No. 202605150065285 in the Knox County Register of Deeds Office, Tennessee, First Century Bank assigned the Note and the Deed of Trust to CV Gay Street, LLC; and
WHEREAS, CV Gay Street, LLC is the owner and holder of the Note and the Deed of Trust; and
WHEREAS, the Note is in default and has been accelerated.
NOW, WHEREFORE, premises considered, Oliver D. Adams, Trustee, will sell for cash at a foreclosure sale requested by CV Gay Street, LLC, the owner and holder of the Note and the Deed of Trust, the property described below (the "Property"). The sale will be at the front door of the City-County Building, 400 Main Street, Knoxville, Tennessee 37902, on July 31, 2026, at 3:30 p.m., prevailing time.

Parcel 1 (304 S. Gay):
SITUATED in District No. 2 of Knox County, Tennessee, and within the 5th Ward of the City of Knoxville, Tennessee, and being more particularly described as follows:
BEGINNING at an old iron pin set in the eastern line of Gay Street (also known as South Gay Street) distant in a southerly direction 50 feet, more or less, from the point of intersection of the southern line of Summit Hill Drive (formerly Commerce Avenue) with the easterly line of Gay Street, said point of BEGINNING being in the centerline of a party wall; and running thence in an easterly direction along the centerline of said party wall, North 63 deg. 09 min. East, 131.09 feet to a new iron pin set in the westerly line of an alley (said alley being known as Fire Street); thence running South 25 deg. 05 min. East, with the westerly right-of-way line of said alley and with the easterly line of a brick wall, 25.4 feet to a new iron pin set in the westerly right-of way line of said alley, common comer to Lot 7-R (the property of Roland & Roland) and the property herein described and conveyed; thence with Roland and with the south face of the brick wall of the building upon the property herein described and conveyed running South 63 deg. 09 min. West, 130.1 feet to a new iron pin set in the easterly right-of-way line of Gay Street; thence with the west face of said building and the easterly right-of-way line of Gay Street, running North 27 deg. 19 min. West, 25.4 feet to an iron pin, the point of BEGINNING, as shown by survey of Hinds Surveying, dated February 15, 1994.
BEING the same property conveyed to Shree Ganesh Hospitality LLC and Ephant Group Friedman LLC, by Warranty Deed from Master OZ 300 Gay St, LLC, dated May 6, 2022, of record at Instrument No. 202205060084835, in the Knox County Register of Deeds Office, Tennessee.
Parcel 2 (308 S. Gay):
SITUATED in the Second (2nd) Civil District of Knox County, Tennessee, and within the 6th Ward of the City of Knoxville, Tennessee, and being Lot No. 7R-2 on the Final Plat of the resubdivision of Lot 7R, Rowland and Rowland, P.C., recorded in Plat Cabinet P, Slide 314-D, in the Knox County Register's Office, to which plat reference is hereby made for a more complete description.
BEING the same property conveyed to Shree Ganesh Hospitality LLC, a Tennessee limited liability company, as to a 68% undivided tenant in common interest, and Ephant Group – Easton House LLC, a Tennessee limited liability company, as to the remaining 32% tenant in common interest, from Master OZ 300 Gay Street, LLC, by Warranty Deed, dated May 6, 2022, and recorded at Instrument No. 202205060084836, in the Knox County Register of Deeds Office, Tennessee. See also that Scrivener's Affidavit correcting the name to Ephant Group – Easten House LLC, a Tennessee limited liability company, filed of record at Instrument No. 202607010000203 in the Knox County Register of Deeds Office, Tennessee.

The Property will be sold AS IS, WHERE IS, WITH ALL FAULTS, AND WITHOUT REPRESENTATION AND/OR WARRANTY, and subject to unpaid taxes, prior deeds of trust, all easements, all restrictions, all conditions, all covenants, the rights of tenants in possession of the Property, if any, prior claims, and/or any matters of record with priority over the Deed of Trust. The proceeds of the sale will be applied to the payment of the Note and all other indebtedness secured by the Deed of Trust and as required by the Deed of Trust and applicable law. The right is reserved to adjourn the day and time of sale by announcement at the time and place set forth above and/or at the time and place of any further adjournment. To the extent there is a discrepancy between the legal description and the address of the Property, the legal description of the Property will control. The terms of the sale, if any, will be announced by the Trustee at the time of the sale and shall be binding. The Property may be offered and/or sold together and/or separately.
