NOTICE IS HEREBY GIVEN that Dolphin Express, Inc. and Port Aransas Dolphin Docks, LLC, as owner and manager, respectively, of the F/V DOLPHIN EXPRESS, its engines, tackle, etc., (hereinafter "Petitioners"), have filed a Complaint and Petition for Exoneration From or Limitation of Liability pursuant to 46 U.S.C. App. § 30501 et seq., and Rule F of the Supplemental Rules for Admiralty or Maritime Claims & Asset Forfeiture Actions, claiming the right to exoneration from or limitation of liability for all claims for loss, damage, death, injury or destruction allegedly caused by, or arising out of, the F/V DOLPHIN EXPRESS' voyage from Port Aransas, Texas, beginning on or about September 23, 2025 and ending on or about September 25, 2025. As set forth in more detail in the Complaint and Petition, one of the persons on board the F/V DOLPHIN EXPRESS claims to have sustained injuries during the voyage.
The F/V DOLPHIN EXPRESS is a 1977 fiberglass charter fishing vessel, of approximately 82 feet in length, with a beam of approximately 21 feet and a draft of approximately 4 feet.
All persons, firms, corporations or other legal entities asserting claims with respect to which the Complaint and Petition seek limitation and/or exoneration are advised to file their respective claims under oath, as provided by Rule F(4) of the Supplemental Rules for Admiralty or Maritime Claims & Asset Forfeiture Actions of the Federal Rules of Civil Procedure, with the Clerk of Court at the United States District Courthouse, Southern District of Texas, Corpus Christi Division, 1133 N. Shoreline Blvd. Corpus Christi, Texas 78401 and to serve on the attorney for Petitioners, Gilman & Allison LLP, Michael S. Prejean, 800 North Shoreline Boulevard, Suite 1050-S, Corpus Christi, Texas 78401, a copy thereof, on or before the 27th day of July, 2026, or be defaulted. Personal attendance is not required.
Any claimant desiring to contest either the right of exoneration from or the right to limitation of liability shall file and serve an answer to the Complaint on or before the above date unless his claim has included an Answer, all as required by Rule F(5) of the Supplemental Rules for Admiralty or Maritime Claims & Asset Forfeiture Actions.
