URBANDALE SANITARY SEWER DISTRICT

URBANDALE SANITARY SEWER DISTRICT RESOLUTION NO. 1-12-9-25 APPROVING AND CONFIRMING PLANS, SPECIFICATIONS AND FORM OF CONTRACTS FOR THE TRUNK SEWER EXTENSION SOUTH OF AURORA TO MEREDITH DRIVE–CONTRACT 1 PROJECT WHEREAS, the Board of Trustees has heretofore approved plans, specifications and form of contracts for the proposed Trunk Sewer Extension South of Aurora to Meredith Drive–Contract 1 Project ("Project"), as described in the Resolution providing for a notice of hearing on proposed plans and specifications, proposed form of contracts and estimate of costs for the project and the taking of bids therefor; and WHEREAS, hearing has been held on objections to the proposed plans, specifications and form of contracts and to the cost of the Project and all objections thereto have been overruled; NOW, THEREFORE, IT IS RESOLVED by the Board of Trustees of the Urbandale Sanitary Sewer District, as follows: Section 1. The plans, specifications and form of contracts referred to in the preamble hereof be and the same are hereby finally approved, and the prior action of the Board approving them is hereby finally confirmed, and the Project, as provided for in the plans, specifications and form of contracts, is necessary and desirable. Section 2. All resolutions or parts of resolutions in conflict herewith by and the same are hereby repealed to the extent of such conflict. Passed and approved this 9th day of December, 2025. D.J. Nawrocki, President ATTEST: Bill Henry, District Clerk RESOLUTION NO. 2-12-9-25 RESOLUTION ACCEPTING BIDS AS FILED FOR THE TRUNK SEWER EXTENSION SOUTH OF AURORA TO MEREDITH DRIVE–CONTRACT 1 PROJECT. WHEREAS, pursuant to notice duly published in the manner and form prescribed by resolution of this Board and as required by law, bids and proposals were received for the Trunk Sewer Extension South of Aurora to Meredith Drive–Contract 1 Project. NOW, THEREFORE, IT IS RESOLVED by the Board of Trustees of the Urbandale Sanitary Sewer District, as follows: Section 1. Said bids and proposals are herewith accepted and filed. Section 2. That all further action with respect to said bids, proposals and the aforesaid Project are herewith set for additional action by the Board of Trustees. Passed and approved this 9th day of December, 2025. D.J. Nawrocki, President ATTEST: Bill Henry, District Clerk RESOLUTION NO. 3-12-9-25 AWARDING CONTRACT FOR THE TRUNK SEWER EXTENSION SOUTH OF AURORA TO MEREDITH DRIVE–CONTRACT 1 PROJECT WHEREAS, pursuant to notice duly published in the manner and form prescribed by resolution of the Board of Trustees and as required by law, bids and proposals were received for the Trunk Sewer Extension South of Aurora to Meredith Drive–Contract 1 Project ("Project"); and WHEREAS, all of the said bids and proposals have been carefully considered, and it is necessary and advisable that provision be made for the award of the contract for the Project; NOW, THEREFORE, IT IS RESOLVED by the Board of Trustees of the Urbandale Sanitary Sewer District, as follows: Section 1. The bid for the Project submitted by the following contractor is fully responsive to the plans and specifications for the Project, heretofore approved by the Board of Trustees, and is the lowest responsible bid received, such bid being as follows: Name and Address of Contractor Amount of Bid Rognes Corporation 1609 N. Ankeny Blvd. Ankeny, IA 50023 $583,785.00 Section 2. The contract for the Project be and the same is hereby awarded to such contractor at the total estimated cost set out above, and the Contract be and it is approved. Section 3. The contract for the Project, be and the same is hereby awarded to such contractor at the total estimated cost set out above, the final settlement to be made on the basis of the unit prices therein set out and the actual final quantities of each class of materials furnished, the said contracts to be subject to the terms of the aforementioned resolution, the notice of hearing and letting, the plans and specifications and the terms of the bidder's written proposal. Section 4. The President and District Clerk be and they are hereby authorized and ordered to enter into a written contract for the Project, with said contractor. Section 5. The amount of the contractor's performance and/or payment bonds is hereby fixed and determined to be 100% of the amount of the contract for the Project. Section 6. That all further action with respect to approving the contracts and performance, payment and maintenance bonds for the Project are herewith set for additional action by the Board of Trustees. Nawrocki, President ATTEST: Bill Henry, District Clerk RESOLUTION NO. 4-12-9-25 APPROVING CONTRACT, AND PERFORMANCE, PAYMENT AND MAINTENANCE BONDS FOR THE TRUNK SEWER EXTENSION SOUTH OF AURORA TO MEREDITH DRIVE–CONTRACT 1 PROJECT WHEREAS, the Board of Trustees of the Urbandale Sanitary Sewer District, in the County of Polk, State of Iowa, has heretofore awarded a contract, as follows: Name and Address of Contractor Amount of Bid Rognes Corporation 1609 N. Ankeny Blvd. Ankeny, IA 50023 $583,785.00 for the Trunk Sewer Extension South of Aurora to Meredith Drive–Contract 1 Project ("Project") and fixed the amount of the performance and/or payment bond to be furnished by the contractor, and instructed and authorized the President and District Clerk to execute the contract, on behalf of the District, subject to the approval of the Board of Trustees; and WHEREAS, the said contract, has been duly signed by the contractor and by the President and District Clerk, and upon examination by the Board of Trustees the same appear to be in proper form; and WHEREAS, the contractor has filed a satisfactory performance bond, a satisfactory payment bond, and a satisfactory maintenance bond in the required amount, as follows: Name of Surety for Performance, Payment, and Maintenance Bonds Amount of Bonds Employers Mutual Casualty Company c/o Anne Crowner, Attorney -in-Fact Holmes, Murphy and Associates LLC 2727 Grand Prairie Pkwy Waukee, IA 50263 $583,785.00 NOW, THEREFORE, IT IS RESOLVED by the Board of Trustees of the Urbandale Sanitary Sewer District, as follows: Section 1. The aforementioned contract, and performance, payment and maintenance bonds be and the same hereby approved and declared to be binding upon the parties thereto. Section 2. All resolutions or parts of resolutions in conflict herewith be and the same are hereby repealed to the extent of such conflict. Passed and approved this 9th day of December, 2025. D.J.
