USDA Forest Service-Humboldt-Toiyabe National Forest-Mineral County, NV Legal Notice of 45-Day Opportunity to Object for Burnt Rock Exploration Project The Bridgeport Ranger District has prepared a Final Environmental Assessment and Draft Finding of No Significant Impact for the Burnt Rock Exploration Project submitted by CP Resources Corporation. This project is a non-HFRA 10-year mineral exploration-only Plan of Operations project located approximately 23 miles west-southwest of Hawthorne, Nevada. The Proposed Action includes the construction of drill pads with sumps, temporary roads, laydown areas, widening of existing roads, and overland travel for a maximum of 250 acres of total disturbance over the 10-year life of the Project. Concurrent reclamation practices would be used over the life of the Project and drill pads, roads, and laydown areas would be fully reclaimed when no longer needed for the Project or when the Project is complete. The Proposed Action incorporates Environmental Protection Measures and Best Management Practices to minimize adverse environmental impacts. CP Resources would conduct seasonal exploration drilling activities as weather and seasonal wildlife restrictions permit. The initial exploration drilling activities include the construction of 266 new drill sites, construction and maintenance of a maximum of 28 miles of new temporary access road, and construction of four laydown areas for a total of 121 acres of new surface disturbance. Future drilling programs would include up to 129 acres with the total disturbance of the Project not to exceed 250 acres for the life of the Project, including a maximum of 600 drill pads, eight laydown areas, and 45 miles of new temporary road. Reclamation would consist of removing all equipment and materials, abandoning all boreholes, backfilling sumps, ripping and recontouring all constructed roads, drill pads, sumps and reseeding all disturbed areas with an approved seed mix. Eligibility to File Objections Objections can be accepted only from individuals and entities who have submitted timely, specific written comments regarding a proposed project or activity subject to these regulations during any designated opportunity for public comment, per the regulations at 36 CFR 218.5(a). Additional eligibilities are established in 36 CFR 218.5(b) through (f). Issues raised in objections must be based on previously submitted timely, specific, written comments regarding the proposed project and a connection to previous comments must be demonstrated in the objection, unless based on new information arising after designated opportunities for comment. Individual members of organizations must have submitted their own comments to meet the requirements of eligibility as an individual. Objections received on behalf of an organization are considered as those of the organization only. If an objection is submitted on behalf of a number of individuals or organizations, each individual or organization listed must meet the eligibility requirement of having previously submitted comments on the project (36 CFR 218.5). Objections received in response to this solicitation, including names and addresses of those who object, will be considered part of the public record on these proposed actions and will be available for public inspection during and after the objection process. Contents of an Objection Incorporation of documents by reference in the objection is permitted only as provided for at 36 CFR 218.8(b). Minimum content requirements of an objection as identified in 36 CFR 218.8(d) include: • Objector's name and address with a telephone number if available; with signature or other verification of authorship supplied upon request. • Identification of the lead objector when multiple names are listed, along with verification upon request. • Name of project, name and title of the responsible official, national forest/ranger district where project is located. • A description of those aspects of the proposed project addressed by the objection, including specific issues related to the proposed project; if applicable, how the objector believes the environmental analysis or draft Finding of No Significant Impact specifically violates law, regulation, or policy; suggested remedies that would resolve the objection; supporting reasons for the Reviewing Officer to consider; and • A statement demonstrating the connection between prior specific written comments on this project and the content of the objection, unless the objection issue arose after the designated opportunities for comment. Objections must be postmarked or submitted electronically or by hand within 45 days following the publication of this legal notice. The publication date in the Reno Gazette-Journal newspaper of record is the exclusive means for calculating the time to file an objection to this Project.
